A Capacity to Litigate Assessment is a way of ensuring a person has the capability to take part in and follow legal proceedings. This relates to an individuals ability and understanding of legal procedures.

Capacity to Litigate is not covered by the Mental Capacity Act 2005, so we use case law and legal test Dunhill vs Burgin.

We will liase with the relevant party to ascertain the details of the legal matter being addressed. We also may require financial information or any medical conditions that may influence an individual’s capacity.
